Continuing Victories in Criminal Tax & White-Collar Defense.

Patrick A. Mullin, a criminal tax and white–collar defense attorney, has a longstanding forty-year history of zealously representing the interests of clients in criminal tax and white-collar criminal matters, including a number of such victories over the past year alone.

“Learning that you are the target or subject of a federal criminal investigation can bring tremendous stress,” says Mr. Mullin, “and during these times, it is essential to retain counsel with the experience and fortitude to thoroughly defend your rights and advocate for the best possible outcome.”

According to a 2019 Pew Research study, federal prosecutors obtain convictions in 99.6% of all federal criminal cases, yet Mr. Mullin has been able to defy these odds for his clients time and again, achieving a number of very rare full acquittals and investigations ending with no charges being brought, as well as reduced sentences, and victories on appeal.

This year, for example, Mr. Mullin assisted three tax preparers who were deemed subjects of separate federal criminal tax investigations in resolving each of their matters on a civil-only basis, with no formal charges being brought.

Similarly, Mr. Mullin represented an attorney who was facing state criminal tax charges, as well as potential federal fraud charges, and was ultimately able to resolve the matter this year on a civil basis, with no criminal charges being brought.

Through the advocacy of Mr. Mullin’s firm, a local businessman received a significant modification of the terms of super-vised released imposed against him in a prior federal criminal tax matter, permitting the client to resume his livelihood as a tax preparer.

Mr. Mullin also represented a client facing criminal tax evasion charges in the State of Iowa and revocation of his restaurant’s liquor license. Through the diligent representation of Mr. Mullin’s fi rm, the client had his criminal matter resolved through a deferred judgment with no term of imprisonment and secured the reinstatement of his liquor license.

A former Marine was facing up to three years in prison on federal criminal tax charges. Through Mr. Mullin’s zealous representation of the client’s interests throughout the investigation and at sentencing, he ultimately received a non-custodial sentence.

Mr. Mullin also separately represented two high-level executives alleged to have wrongfully diverted significant funds from their employers and was able to resolve each matter through a civil settlement, with no criminal charges brought.

Finally, the owner of several businesses in the San Francisco Bay Area was the target of a federal criminal tax investigation and facing serious federal tax charges. Mr. Mullin represented the client throughout the investigation, which ultimately resulted in no charges being brought.

Mr. Mullin has a long history of achieving these rare victories for clients, whether during the investigation stage, at trial, during sentencing, or on appeal. Last year, Mr. Mullin achieved a landmark verdict for his client, former star basketball player for the New York Knicks and Atlanta Hawks in the NBA and for the Beijing Ducks in the CBA, Randolph Morris, when a Lexington Kentucky federal jury acquitted Morris on 11 counts of criminal tax violations. Also last year, Mullin secured a very rare reversal from the U.S. Court of Appeals for the Fourth Circuit and release from detention for a 19-year-old defendant being held without bail.

In 2012, Mr. Mullin secured a full acquittal as to federal tax charges brought against a New Jersey businessman. In 2011, Mullin secured full dismissal of a 6-count federal indictment against a defense contractor charged with procurement fraud as a separate corporate plea, without jail time, was entered based upon key employee misconduct. In 2007, Mr. Mullin secured a full federal jury acquittal in Manhattan on 10 counts brought by the DEA’s Diversion Unit against a physician, marking its first full major reported defeat

Patrick A. Mullin is a veteran federal criminal defense attorney with repeated victories in high-stakes criminal and tax matters. With 42 years of practice, Mullin is considered across the U.S. and internationally as a go-to lawyer for those under criminal or tax investigation, facing indictment, or pursuing an appeal. He is an alumnus of Harvard Law School and a graduate of NYU’s renowned tax law program. Mullin has also served on the faculty of legendary Gerry Spence’s Trial Lawyers College. With offices in New York City, Washington, D.C., and Fort Lee, New Jersey, he has argued before the United States Supreme Court in a major federal criminal sentencing matter and is the recipient of numerous professional accolades.
