Often policies are differentiated by who is protected, for example, owner’s title insurance vs. lender’s title insurance.

When you purchase a property, you expect to receive clear and undisputed ownership rights. However, there could be hidden risks associated with the property's title that may affect your ownership or financial interests. These risks can include deliberate acts such as fraud, or concerns such as:

  • Unresolved liens.
  • Undisclosed heirs.
  • Forged documents.

The purpose of title insurance is to mitigate these risks by providing coverage for any loss or damages that may arise due to title defects. It serves as a safeguard, ensuring that you have a valid and marketable title to the property, free from any encumbrances or defects that could jeopardize your ownership.

In a real estate transaction, the buyer typically purchases a title insurance policy to protect their investment. The title insurance company conducts a comprehensive title search and examination to uncover any potential issues related to the property's title history. This process involves reviewing public records, deeds, mortgages, court records and other relevant documents to assess the property's chain of ownership and verify the absence of any outstanding claims or defects.

Once the title examination is complete, the title insurance company issues a policy that guarantees the buyer's ownership rights. If any title issues or claims arise in the future, the title insurance company is responsible for addressing them and potentially providing compensation for any financial loss incurred.

It's important to note that title insurance policies are typically one-time premium payments, providing coverage for as long as the insured party holds an interest in the property. This is in contrast to other forms of insurance that require ongoing premiums.

In real estate transactions involving lenders, there is also a separate type of title insurance called lender's title insurance or mortgagee's title insurance. This policy protects the lender's financial interest in the property and is typically required by mortgage lenders to secure their investment. With lender's title insurance, the cost is borne by the buyer.

If a previously undisclosed claim arises or a defect in the title is discovered, the title insurance company will cover the costs associated with defending the title and compensating for any financial loss suffered by the insured party.
