I represent professional clients in business disputes, civil trials, and arbitrations. I regularly represent clients in partnership disputes, business divorce, and other business separations as well as legal malpractice and other professional liability cases. My commercial litigation practice includes contract disputes as well as cases involving misappropriation of trade secrets, fraud, negligent misrepresentation, breaches of fiduciary duties, embezzlement and other theft, and other business-related torts. I have served families, individuals, companies, and trusts that have been harmed in business schemes and questionable investments. I represent beneficiaries and fiduciaries in trust and estate litigation. I have earned a reputation for success in complex, sensitive, and high-profile disputes.

I also represent clients and help other clients co-counsel personal injury cases that involve unique business issues. For example, I have represented clients in claims against major oil and gas companies in cases involving wrongful death, oil and gas leaks causing property damage, and unfair business practices, I also have represented victims of sexual assault pursue justice in instances where their assailants tried to conceal assets as well as cases in involving corporate bad actors, including major transportation companies and medical practices. As another example, I represented the family of a murder victim in holding a Scientology based company and its owners responsible for his death.

Ethics, Professional Liability and Attorney Malpractice

My approach to trial practice for the past two decades has been one that is creative and tailor-made in order to obtain the desired result for my clients. For example, professional malpractice cases are unique and can be more complex than personal injury. When a trusted professional such as an attorney, real estate broker, or accountant commits an error or engages in wrongdoing, it is especially devastating to the client. I treat every client and every case as unique. I work closely with my clients so they understand their options, and together we pursue the solutions best suited to their specific cases and circumstances. I have recovered millions of dollars against licensed professionals who have injured their former clients through negligence or other wrongdoing.

For more than a decade I have been a contributing author to Lawyers Professional Liability in Colorado, the leading comprehensive treatise on legal malpractice in Colorado. The publication is a guide for every Colorado attorney, regardless of practice area, and discusses legal ethics, client-lawyer relationships, and attorney discipline. I advise other lawyers and law firms on issues involving professional ethics and liability through lectures at continuing legal education seminars. I also served as the President of the Colorado Trial Lawyers Association in 2015-2016.

Fraudulent Conveyance in Colorado

As a business plaintiff attorney, my experience in finding assets that debtors try hide to avoid paying a claim or judgment is of importance when it comes to resolving high-stakes disputes. I have recovered millions of dollars for clients through strategic and thorough investigation and by novel arguments and legal theories under the Uniform Fraudulent Transfer Act. I’m often hired by other attorneys to help locate and recover defendant’s assets. I also have testified as an expert witness in similar cases.

In addition to writing and extensively lecturing about fraudulent transfers in Colorado civil matters, I led an effort in 2014 to amend the law to penalize debtors who transfer assets with intent to hinder, delay, or defraud creditors. That successful effort was a result of my experience representing plaintiffs against defendants who seek to avoid paying claims by simply transferring their assets.
